Jard General Terms

1. General

These general terms ("General Terms") govern the use of the Jard platform ("Platform") provided by Yardscape Oy (Business ID 3579881-7, "Jard"). The Platform is an online service that connects private individuals seeking household and property services ("Customer") with independent traders offering such services ("Partner"). Customers and Partners are together referred to as "Users".

By using the Platform you agree to these General Terms together with the role-specific terms that apply to you:

  • Customer Terms of Service apply to Customers
  • Jard Partner Agreement applies to Partners
  • Privacy Policy (jard.fi/privacy) forms part of these terms

If you do not accept these terms, you may not use the Platform.

In matters concerning the role of a Customer or a Partner, the role-specific terms prevail over these General Terms.


2. Jard's role and the Partner's status

Jard is an intermediary. Jard does not produce, perform, or sell household or property services. Jard is not a party to the service contract between a Customer and a Partner.

When a Customer submits a request through the Platform and a Partner responds with an offer that the Customer accepts, a service contract is formed directly between the Customer and the Partner. Jard only enables the connection between Customer and Partner and provides the Platform for their communication.

The Customer pays the Partner directly for the service. Jard does not collect, process, or remit payments between Customers and Partners. The only payments that flow through Jard are lead fees paid by Partners to Jard (see the Partner Agreement).

The Partner acts independently and at the Partner's own risk and is not an employee, agent, representative, or subcontractor of Jard. Nothing in these terms creates an employment relationship, agency, partnership, joint venture, or franchise between Jard and the Partner.

Jard is not responsible for the quality, content, timeliness, or outcome of services performed by a Partner, nor for any damage caused by a Partner to a Customer or a third party. Disputes between a Customer and a Partner are primarily resolved between them.

The Platform is provided "as is" and as available. Jard does not warrant uninterrupted operation, error-free functioning, or fitness for any particular purpose.


3. Eligible Users

The Platform is intended for adults residing in Finland who order services primarily for their household or private use. Use of the Platform on behalf of housing companies, property managers, businesses, or other legal entities requires a separate agreement with Jard.

Partner eligibility is set out in the Jard Partner Agreement. In short, only businesses or traders registered in Finland and holding a Business ID may register as a Partner.

5. User account

Use of the Platform requires creating a user account. The User agrees to:

  • be at least 18 years old
  • provide truthful and up-to-date information at registration and afterwards
  • keep credentials and passwords confidential
  • be responsible for all activity on the account
  • notify Jard without delay of any suspected unauthorised use of the account

The account is personal and may not be transferred to a third party without Jard's written consent.


6. Permitted use and prohibited conduct

The Platform may only be used for lawful purposes and in accordance with these terms. The User agrees not to:

  • impersonate another person or provide misleading information
  • circumvent, test, or breach the Platform's security or access controls
  • send spam, advertising, harassing, or threatening content
  • infringe the copyright, trademarks, or other rights of any person or entity
  • publish unlawful, discriminatory, hateful, or otherwise inappropriate content
  • use automated tools (such as bots or scrapers) without Jard's written consent
  • arrange services off-Platform that were found via the Platform, except as permitted under the Partner Agreement

7. Jard's moderation and enforcement rights

Jard reserves the right, at any time and in its sole discretion, to:

  • remove, edit, or hide content published on the Platform (listings, reviews, messages, images)
  • refuse a registration or close a user account
  • temporarily suspend a user account pending investigation
  • block individual offers, bookings, or transactions
  • carry out checks relating to suspected fraud or misuse and disclose information to authorities to the extent required by law
  • restrict access to specific Platform features for individual Users or groups of Users

Jard will notify the User of material measures where reasonably possible, unless notice would jeopardise an investigation, the safety of other Users, or a legal obligation.


8. Privacy

The processing of personal data is described in a separate Privacy Policy (jard.fi/privacy), which forms part of these terms.


9. Intellectual property and User content

The Platform, including its software, user interface, code, text, images, logo, and other material, is the property of Jard or its licensors and is protected by copyright and other intellectual property rights. For the term of these terms, the User is granted a limited, non-exclusive, revocable, and non-transferable right to use the Platform in accordance with these terms.

The User retains rights to content created by the User (such as reviews, photos, and messages). The User grants Jard a worldwide, royalty-free, and sublicensable right to use this content for the operation, maintenance, development, and marketing of the Platform. This licence survives the closure of the User's account to the extent content has already been published on the Platform or used in Jard's marketing materials.

The User is responsible for ensuring the right to publish any content the User uploads and that the content does not infringe the rights of any third party.


10. Limitation of liability

To the maximum extent permitted by mandatory applicable law:

  • The Platform is provided "as is" and as available.
  • Jard is not liable for defects, delays, quality, or damage relating to services performed by a Partner.
  • Jard is not liable for indirect or consequential damage arising from the use of the Platform, including loss of profit, loss of business opportunity, loss of data, or reputational harm.
  • Jard's total liability towards a single User is limited to a maximum of EUR 500 per individual incident and a maximum of EUR 2,000 in aggregate during a calendar year.

Consumers always retain their mandatory statutory rights (including under the Finnish Consumer Protection Act 38/1978). Nothing in these terms limits those rights.


11. Force majeure

Jard is not liable for any delay or failure to perform caused by circumstances beyond Jard's reasonable control. Such circumstances include telecommunications or server outages, cyberattacks, governmental measures, industrial action, fire, natural disasters, pandemics, and equivalent disruptions affecting Jard's subcontractors.


12. Changes to these terms

Jard may amend these terms. Material amendments will be notified to Users at least 30 days in advance by email or via the Platform. If you do not accept the amendments, you may stop using the Platform before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the amendments.

Amendments that are solely beneficial to the User, or that are made to reflect changes in legislation or to correct clerical errors, may be notified on shorter notice.


13. Governing law and disputes

These terms are governed by the laws of Finland, excluding its conflict of laws rules.

Disputes are resolved primarily by negotiation; please contact info@jard.fi in the first instance.

If no amicable solution is reached:

  • A Consumer Customer may refer the dispute to the Finnish Consumer Disputes Board (kuluttajariita.fi). Free advice is also available from the Consumer Advisory Service (kkv.fi/kuluttajaneuvonta).
  • Disputes are ultimately resolved by the District Court of Helsinki, unless a consumer has the mandatory statutory right to bring the action before the court of the consumer's domicile.
